NMSP investigates shooting at residence in Penasco

Penasco, NM – On January 13, 2025, the New Mexico State Police Investigations Bureau investigated a shooting at 15018 NM 75 in Penasco, NM.

Investigations Bureau agents learned that around 8:30 p.m., Taos County Sheriff’s deputies were dispatched to 15018 NM 75 in Penasco in reference to a report of domestic violence and arson incident, which resulted in a shooting. A husband and wife stated their daughter’s husband, identified as Jeremy Garcia (32) was attempting to set the residence on fire with the three family members inside.

Agents later learned that just before the shooting, Garcia and his wife had gotten into a physical altercation, with Garcia holding his wife down on her knees by her hair. Garcia’s wife was able to get free and close the door, locking Garcia out of the house. A short time later, flames were observed on the porch of the residence. The wife’s father confronted Garcia through a window of the residence while the fire was still active, and fired at least one round from a firearm, striking Garcia. The father was then able to extinguish the fire. Garcia was pronounced deceased on scene by the Office of the Medical Investigator.

The State Fire Marshal was contacted and an investigation into arson is underway. At this time, no charges have been filed. This incident remains under investigation by the New Mexico State Police Investigations Bureau.
